1. Acceptance of Terms

By accessing or using the Vibe Coding eBook website, services, applications, and content (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and CodeVibe, Inc. ("CodeVibe," "we," "us," or "our") regarding your use of the Services. By accessing or using the Services, you represent that you have read, understood, and agree to be bound by these Terms.

3. User Accounts

To access certain features of the Services, you may need to create a User Account. When creating a User Account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your password and for all activity that occurs under your User Account.

We reserve the right to suspend or terminate your User Account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

4. License and Usage

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial purposes.

For Users who have purchased the eBook or any premium resources, we grant a limited, non-exclusive, non-transferable license to access and use the purchased Content for your personal learning and development purposes only.

Educational institutions or organizations that have purchased organizational licenses may use the Content for teaching or internal training purposes, subject to the specific terms of their license agreement.

5. Intellectual Property Rights

The Services and all Content contained therein, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to CodeVibe and are protected by United States and international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

Nothing in these Terms grants you any right to use any trademark, design right, or copyright owned or licensed by CodeVibe or any third party.

6. Restrictions

You agree not to:

• Copy, modify, create derivative works of, publicly display or perform, republish, download, store, transmit, sell, rent, lease, lend, or distribute the Content without prior written permission from CodeVibe;
• Use the Services to store or transmit malicious code;
• Interfere with or disrupt the integrity or performance of the Services;
• Attempt to gain unauthorized access to the Services or related systems;
• Use data mining, robots, or similar data gathering and extraction tools on the Services;
• Circumvent or disable any security or other technological features of the Services;
• Use the Services in any manner that could damage, disable, overburden, or impair any CodeVibe server or the networks connected to any CodeVibe server.

7. Payment and Subscriptions

Some aspects of the Services may be available for purchase or subscription. By purchasing or subscribing to such Services, you agree to pay all fees and charges associated with your purchase or subscription.

For subscription-based services, your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date. You may cancel your subscription at any time through your User Account settings.

All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law.

8. Privacy Policy

9. Third-Party Services

The Services may contain links to third-party websites or services that are not owned or controlled by CodeVibe. CodeVibe has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that CodeVibe shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

CODEVIBE DOES NOT WARRANT THAT: (A) THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CODEVIBE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless CodeVibe, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Content other than as expressly authorized in these Terms.

13. Termination

We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
